I fell asleep at the wheel, and rear ended a parked car not even a block away from my house. I think i then remained passed out due to impact. when i came to i was scared and confused i proceeded to drive home to check on my baby and husband who had to be at work shortly and so i wouldnt block the street and as i was leaving out my house to check on accident a cop was there to tow my cousin car away and gave me a ticket. I did not try to run and hide. i wanted to take responsibility for what happened because my cousin had no insurance and i was driving his car.
It could cost you more than money. It could cost you jail time or suspension of your driver's license. I would hire an experienced criminal defense attorney in your area.
Nothing in this communication should be construed as creating an attorney client relationship. This is for informational purposes only. Attorney will take no action on your behalf unless and until a written retainer agreement is signed. There are strict time deadlines on filing claims and, as such, you are advised to consult with and retain an attorney immediately to file such claims timely or you will lose any right to recovery.
Do not take this case too lightly. Leaving the scene of a property damage accident is a criminal offense and not a traffic ticket. Additionally, because the offense is under the Motor Vehicle Code, it can NEVER be expunged from your criminal history and you will have a misdemeanor conviction for the rest of your life. Granted, leaving the scene of a property damage accident is not a felony or a crime involving dishonesty but in these days of easy access to a person's criminal history via the internet, I would fight to keep any offense off my record. You never know how a future employer, creditor, or someone else researching you will look at the criminal conviction.
The cost to hire an attorney is not one that anyone likes to incur. On the other hand, not hiring a good attorney has the potential of costing you far more in the future. You need to consult with a 10.0 Rated Michigan Criminal Defense Attorney who is not afraid to win your case! This is a serious matter and you should consult an attorney that specializes in criminal defense work. The final result will dictate what the fines will be so finding a reputable and competent attorney is very important.
The problems associated with leaving the scene of a property damage accident are the penalties. There is a $1,000 drivers responsibility fee for each of the next 2 years issued by the Secretary of State. 6 points are added to your driving record. The court can and will likely put you on probation for up to 2 years. There are issues associated with the assessment of fines, cost, and probation oversight fees. Additionally, the Court can order community service as part of the sentencing.
Since the vehicle was not insured at the time of the accident, you are legally responsible for the entire damage to the parked vehicle. Failure to pay for the damage can result in the loss of your driving priviledges.
On the positive side, the officer came in contact with you shortly after the accident was hopefully was able to determine you were not under the influence of drugs or alcohol at the time of the accident and no one presumably was hurt in the accident. A good attorney should be able to avoid many of the penalties in a fact pattern like this one.
