Husband relapsed after 4+ years of sobriety and came home intoxicated. I didn't want him using in our home so I threw his phone outside onto the front porch and locked him out when he went to retrieve it. He then kicked the door in to come back inside. He didn't lay a hand on me and would never do so. I had already planned to call the police to either make him leave or take him to jail bc I knew he'd be forced to stop using. The police charged him with domestic assault but no order of protection. I stated to the officer I didn't agree with the charge and hadn't been fearful, but shocked. The cop came by a few days later to check on us. Talking separately to him, we both stated things were fine, he was back to work and meetings. To have him serve time would be a great hardship on our entire family. There's been no incidents since that night 2 months ago. What can we expect at his court date tomorrow? He has a prior drug charge from almost 20 yrs ago only. I don't work but have a lot of physical problems from arthritis & have anxiety. I depend on my husband to help me with our 12 yr old son. We've been married 10+ yrs and are basically happy.
He can expect to have his FREE or hire Criminal Defense Attorney get all the discovery, police reports, evidence and facts and negotiate with the prosecutor down the road or hopefully getthe case dismissed. best guess here with no case.
