Assuming an ALS hearing is scheduled, all that judge really deals with is the legitimacy of the stop. If you can show, somehow, that the initial stop of the vehicle was not legal, or that the officer didn't perform the FSTs or chemical test properly, there won't be an administrative suspension before the main criminal case against you. If you've already plead guilty (it's unclear from your facts), your license is suspended by law and there will not be an ALS suspension. You should see about getting a temporary permit to drive, but you'd have had to first get a certificate of 1st DUI in 5 years at your plea. Without that, you can get full reinstatement after 120 days, but you have lots to do first. Good luck!
The information I've provided was general in nature and should not be relied upon in your particular situation. Much more detailed information is required before I can provide you with my advice on how, exactly, you should proceed. My responding to your inquiry does not constitute, in any way, an attorney-client agreement or relationship.
An ALS hearing is an abbreviated hearing the State uses to take unsafe drivers off the road. I would advise hiring an attorney if you are facing a DUI to help you navigate the nuances of these types of cases. The answer to your question depends on what your goals for the case are- fighting the case or keeping your license. This also depends on whether you refused or consented to the state chemical test.
