we applied for i485/140/765/131 in Jan 2016. (EB1C/L1) FP done is Feb. I-140 approved in Feb. Dependents got ead/ap in Marc, but primary did not received yet (97 days) . We got RFE for primary and 1 of the dependent. evidences were submitted.
I'm worry just, because our visa is going to expire in Jun.
we asked our attorney (employer's attorney) to raise SR or expedite for EAD, but she told : it is ok, just wait.
So my questions
- should we start our visa extension process or just wait any more?
- does RFE for 485 effect on primary's ead delay?
thanks for answers/advices
1. "- should we start our visa extension process or just wait any more?" No need to "extend" your "visas" - you are now all applicants for I-485 AOS, and as such, in a legal period of stay "authorized by the Attorney General".
2. "- does RFE for 485 effect on primary's ead delay?" Yes, absolutely, and the RFE clearly states so - have your read it?
