It’s a long story and I don’t know how to guide my Son what to do.
Someone is trying force him to pay $6750 in damages to a bathtub at a wedding venue he and his girlfriend were at.
He and his girlfriend had an argument in the bathroom, he pushed her wheel chair away from him so he could get out of the bathroom and away from the argument. She is paralyzed waist down. The back of her wheelchair hit the tub and cracked it. This guy is now saying if my son does not pay him $6750 he’s going to press criminal charges. Or take him to JP court. It was an accident completely and the old tub is a plastic molded tub that is 26 yrs old. So it was very old plastic and most likely brittle. But he wants the entire tub and fixtures replaced.
My Son has no money only makes $9 hr.
No savings he’s 25. He’s asked if he could work it off and was told not.
Intent is not the issue, causation is. Your son caused the damage. What is in question is the proper amount of damages.
