On June 3rd, my ex-boyfriend and I go to court to get the restraining order off of him because I am currently pregnant with his baby and I no longer fear him whatsoever. On the paperwork I had put that I want the restraining order off him because we constantly run into each other in public and I feel bad that he always has to leave wherever he is because he poses no threat. But, I don’t know if this will be enough to get the domestic violence restraining order off of him but I am scared to mention I’m pregnant with his baby and that’s why I want it off because I don’t want him to get in trouble for breaking the no contact order. What should I say to the judge to make sure I get the no contact order off of him?
You can tell the judge exactly as you stated: that you do not have fear of harm from him. I hope it is true that you no longer fear harm from him. If you have not already done so, you may file paperwork to terminate the current restraining order (I am not sure if the current restraining order is going to expire or if you've already requested to terminate). Or you can just wait until the hearing date. You wish to seek help from the self-help window in your courthouse. Lastly, if you fail to appear for your hearing, the restraining order will not be granted. Good luck to you!
Do you have a Temporary Restraining Order, or do you have a more permanent restraining order?
