Recently my sons mother violated court order ( no alcohol 24 hours prior and during time with our child) 2 Police officers came took pictures of her home hoarded beer bottles and a recording of her admitting she beers and was obviously intoxicated with our son. Cps released our child to me. The police did not arrest her but will charge her child neglect and endangerment. week before a parent called cps on mother picking up our son stumbling and appeared drunk. But school assessed her to be coherent and let her go. that same day she had minor car accident with our child i suspect her drunk driving but no hard proof. She had no car that week & took our child via taxis to school during her time. Also observed her drunk during child exchange. (I called police /cps ) I filed ex parte . During court she & lawyer denied the whole incident ever occurring (report not filed and complete) the police officer emailed me the pictures He took with note to show the judge as proof and I gained temp. custody. the lawyer and mom still deny it. I cannot afford a lawyer. I want to make sure all report is presented & I gain full custody. pay for past lawyer fees and loss.
If CPS no longer has the case you may file an RFO to modify custody. You certainly have ample facts and may bring CPS back in if you do not file such a motion to protect your children.
