I got a DUI in Arizona 2 years ago with a California license. Now living in California and recently applying for a job, the .08 misdemeanor DUI showed up on my background check and prevented me from getting a job (only record I have), although this position does not require handling a motor vehicle. What can I do to get this cleared/expunged from my record? Does this deal with the California or Arizona DMV/court?
You need to retain an attorney in Arizona to petition the court to expunge or seal your conviction, or whichever remedies are available under Arizona law.
Your problem is that even if you get the case "expunged" in Arizona (you need an attorney there for that) it will stay on your California DMV record. Even if driving is not required, they may require you to have a valid CDL and that is where it will show up without any way to remove it (unless the elements of the DUI in Az would not constitute a DUI in California).
You have the right to see why they didn't offer you the job I believe, but I only do criminal defense. You may want to consult an employee side labor lawyer.
