I was arrested this last Sunday for possession of 1.6-2 grams of marijuana after being pulled over for going 42 in a 35, I was curious as to what actions I should take following this arrest that will give me the best chance of getting my record expunged. I’m 18 with no previous criminal history, I am a pre medical biology major at Stephan F. Austin State University in Nacogdoches, Texas, and have always had a well above average GPA. I was also curious as to what the usual outcome to cases like mine is, being that I was arrested for possession of such a small amount. I’ve looked into pre trial diversion programs, and would like an opinion as to if, In my case, this may be a good option to look into, and if not if there are any other programs I can complete that will result in the expungement of my now criminal record, or the dropping of the case. I do not want this incident to haulter my future success as I am planning to enter medical school in the future.
The first thing you should do is interview and hire an attorney. Depending on your jurisdiction, a local and quality criminal defense attorney should know what programs are offered through the District Attorney's office as well as what additional factors, like clean UAs or regular counseling or attendance at AA/NA, will assist in your acceptance to these programs. Good Luck.
