I live in a building with 30 units total. This building has Bedbugs.. The exterminator would spray and the issue would reside for a couple of months and come right back. I want to go to court. I am throwing my furniture away and I want my money's worth. Is it worth me going to small claims or housing court? I want to move but can't afford it.. The landlord needs to exterminate entire buildings
You can do both a small claims/superior court case for damages and a housing code enforcement case. You don't need a lawyer for either. Have you complained to the town about the bedbug condition? Do you have any records? If not, build up your evidence. The code enforcement case requires that you start paying your rent into court. And this type of case allows the court to award "money" and to force the landlord to fix the issues.
And we have a new public act 16-51 that became effective in late 2016 that specifically addresses what should be done when bedbugs are present. This act is in addition to other remedies meaning you can still call your local housing inspector and building department if you have an infestation.
So you have lots of options. Consult a lawyer.
