Hello I am currently taking my childs' father to court for child support. We have established paternity and he has signed admitting to be the father. He told the judge he was having surgery and was unable to work. Judge told him to come back with proof he was having surgery and note from his doctor stating that he could not work. He did not bring those documents. He did not show up to court last month and he just sent me a text telling me hes not coming next month either. What should I do? should I let someone know ahead of time should I just stop going? Will he still have to pay if he never shows proof that he is working?
send him a notice pursuant to illinois supreme court rule 237c google it. have hm bring pay stubs and last years taxes and bank statements and credit card statements and proof of recent surgery being the hospital admitting form, discharge form, surgery report and the bills.
Gary is right if the guy actually shows up which is questionable based on what you say. Support order can be entered even if he does not appear and you don't have exact information about his income. Should talk to an attorney in your area who can get some information from you about father'story.
