What should I do ?
My renters have paid first and last months rent plus security deposit. Now the month prior to the last month they say they will not pay. They claim I can use the security deposit.
The one year lease contract in bold print states the security deposit can not be used for rent.
They promised to pay tv bill through lease period and have paid it for the last year and a half now they can't afford it since they have paid to rent somewhere else.
Looking for proper action.
A tenant absolutely cannot use a security deposit for last month's rent - the problem is what to do about it. If you want to try, you issue a 72 hr notice and immediately file to evict when it is up. Depending upon your timing, you can be in court before they are out and force them into paying or having an eviction on their rental record.
