My mother kicked me out a few days ago. At that time I was living in Boston. Now I live with my father in Florida. My mother has a tendency of changing her mind and she's the type to randomly demand that I return or she'll press charges on my father for kidnapping. She currently has full custody. I'm 16. What can I do to ensure that she'll sign over custody permanently to my father. Also my father does not make as much money as my mother so my mother always uses this as a weapon and claims my father is not capable of providing for me.
The short answer is there is nothing you can do to ensure that you will be able to stay with your father. However, if things are taken into a court proceeding, your at the age where a judge will consider your opinion on which parent you wish to live with and listen to your reasons why. I practice in Florida, so I cannot really speak for law where your mother lives, but the standard for custody issues is always "the best interest of the child". The other issue may be where the custody order was first entered into because that's likely where the custody would have to be modified. Additionally, if your mother kicked you out, it is unlikely she woudl be able to press charges against your biological father for kidnapping in this situation. Hope that helps a little.
