DUI per se means they are accusing you of driving with a blood alcohol concentration above the legal limit of 0.08. DUI less safe means they are also accusing you of driving after consuming any amount of alcohol that rendered you a less safe driver. They are different ways of charging you with the same offense. Under ocga 40-6-391 (a)(1), DUI less safe indicates a police officer believes you were a less safe, less skillful, less capable driver because of alcohol consumed prior to driving. There are 5 basic ways to be charged with Dui OCGA 40-6-391 (a) 1-5. if it is (a)1 which is less safe it means that the officer beloved you were intoxicated to the point that you were a less safe driver. (A)5 which is also alcohol means you were over the legal limit as set by the Georgia legislature (or over .08).
