My husband sold stuff rented from rent a center stupid yes . not with out my knowledge anyways he HAS FILED CHAP13 we have case number etc .. They showed up today saying they had got the okay to get the stuff we haven't been to court hearing go 5.9.16 is this legal ? Can he go to jail when the realize he no longer has the stuff .. They said they had a writ of possession. However the manger has lied many times and violated serval privacy laws but that's a totally diffrent matter
This is not a LL-T question. It is more properly a consumer rights and/or a criminal defense question. You should re-post your question in both of those categories. I think it is however clear that he had no right to sell the items he was renting. He had the right to posses and use the things, but had no ownership interest, thus no right to sell the items. It may in fact be a crime. BK will not help him deal with or defend against a criminal action. It may be up to the rental company as to whether they seek prosecution of the "theft" of their items, and as such to prevent that from happening, it may be up to him to make them happy or satisfy their demands. You/he absolutely needs the assistance of counsel in this matter, in the BK process as well as any potential criminal case against him.
