My son's father and I are no longer together. I am moving into an apartment with my new significant other and we were not married. What rights does he have as the father, as in visitation rights, rights to have a say in who our son can live with, etc. I just want to know just in case we have to go to court for a custody battle. He signed the birth certificate, but as I said we weren't/aren't married. I am a stay at home mom with our 7 month old son and I take care of him 24/7 every day and night. I take him to his doctors appointments and his father only helps financially, but he says a judge will grant him full custody. I need advice.
Right now he has no rights. He will have to go to the family law court and file a petition for paternity. It is highly doubtful he would get full custody. The best he can probably hope for is 50/50 and that is not a given. You should really contact a family law attorney for a consultation. Most AVVO attorneys offer a free initial consultation. Call one of us today. Good luck.
