I've been involved in a lengthy family case and my initial Judge was recently transferred to a new division and a new Judge assigned. Just yesterday however I discovered that my former Judge's husband is an attorney who represented my ex's new significant other (who has a front row seat at all the hearings by the way). Would this relationship be considered "a person within the third degree of relationship to the Judge". After learning this I understand why the Judge's conduct has been completely egregious and biased against me including a 2 day jail sentence for contempt that was clearly not willful as could be reasoned by the testimony of both me and my ex on the matter. There is also a record of her recusing herself from other cases involving the new girlfriend. I understand I have limited time to file a motion for recusal or disqualification however my Attorney seems reluctant to file this (my issues with him are another story). I thank you all in advance for any advice.
The problem here is that you reference THE FORMER judges relationship so there is no recusal for a judge NOT on your case. You may need to retain a lawyer to review the prior rulings and see if some challenges may be warranted.
