My brother was accused of driving with a suspended license in Texas. He was sitting in the drivers seat of the vehicle while pumping gas. His wife was inside the store paying. The officer pulled up and asked to see his license because they had crossed a public road that runs through a mall parking lot. The officer did not see him driving. He is about to have to spend 60 days in jail and have his license suspended for 2 more years. He hasn't driven for over a year and a half. The store refuses to give him the video from the day.
Your brother should hire an attorney. They will be able to assist you in obtaining the video surveillance and defending him in court. If there is physical (video surveillance) and testimony evidence (his wife's testimony), there may be enough to defend the claims against him.
