I was working 2 full time jobs. Injured on one of them. Continued working second one for as long as possible. Workers comp aware, second employer was not. Am worried workers comp trying to find loop hole. Did not want my second employer to know... May want to return one day

It seems very aggressive of the defense lawyer to subpoena records from 1st employer. But this can be legal if they are seeking to show your hours and pay increased in job #1 after disability occurred in the WC job #2, for which you are receiving benefits. You didn't mention whetheror not the other job was lighter and your comp injury employment was more strenuous or whether your doctor took you "out of work" or merely gave limitations. All these type thing are important. A subpoena may be resisted in some cases if it is overbroad or harrassment. Plainly you need to consult with and possibly hire a good workers comp specialist. Most give free consultations and base fees on contingent recoveries of disputed benefits. If you are facing a hearing, as seems likely when subpoenas are used, you have disputed benefits.
