My son and I live in Maine. His bio father moved to Colorado 8 years ago, is $18,000 in arrears of court ordered child support and stopped contacting my son in any manner at that time as well.I have had primary, sole, physical custody and/or decision making rights, it’s quite confusing between all the state, then Federal differences between all these legal terms.I had my heart broken last night after spending about a week hospitalized. What I have been told is that my son was taken on a flight all the way to Colorado with his absentee father yesterday and that this was done on counsel of a CPS worker who said my son “definitely” would have been put into foster care if he would be back in his lifelong home with me upon discharge. It doesn’t make sense especially with no family assessment attempted nor providers or anyone else contacted by anyone.I have yet to hear from a caseworker, have no papers or even 1 call.I was even more accessible than usual at the hospital and it was not a secret.I don’t know much at all but from the little I do know,it seems unlikely that any of this was in accordance with the law. What concerns me the most is what to do first, next, next so on..
You should contact an experienced family law attorney in your area immediately. These types of cases are difficult and complex, and depend a lot upon the particular facts in each situation.
