Think you'll find that even if neighbor doesn't think through this issue, the fence contractor will. Consequently, the new fence will be placed at least one millimeter inside neighbor's property line, to give evidence to the fact that neighbor owns it -- not you. Neighbor likely has to furnish you six months' advance written notice, during which you'll need to get neighbor's consent to attach your side fence.
