I have not seen my daughter in 6yrs. She lives in another state from me. She is 7yrs old. She does not know me as daddy. She calls my ex wifes' new husband daddy. Me trying to get involved with her now would jusy become confusing for her. I also have no real expectations of ever being able to see her to establish this relationship.
If she lives in another state, that state would likely have jurisdiction since that is where the child has been living. Consider re-posting this question in the state where she lives if it's not in South Dakota. Otherwise, if you live out of state and the child lives in South Dakota, the mother would generally be the one to petition for termination of parental rights - BUT, Mom's new husband will also need to petition for adoption. There is a strong public policy in this state that children be supported by their natural parents, and judges generally do not let parents unilaterally give up their parental rights unless it's a situation where another adult is willing to step in, adopt the child, and be responsible for the child.
