If a kid committed a class one demeanor, petty disorderly person act, or a disorderly person act, what is the lowest age allowed to be sentenced to jail for such crime in New Jersey?
NJ does not have misdemeanors, class one or otherwise. Juveniles do not go to jail in NJ they are detained unless waived to adult court. Detention is extremely unlikely for a DP at any age. They would need to be an extreme prior record for detention on a DP. Under 16 could likely not put together such a record.
Jail aka detention for a disorderly persons offense juvenile under the age of 16 is pretty rare but can happen. Obviously someone with an extensive prior record could go to jail.
