Last week I recieved an administrative citation for public urination. I've never gotten a ticket before and I'm trying not to panic. There's no court date so I would assume that I will be getting something in the mail? What is the worst case scenario and how should I handle this?
First, conviction on this is merely an infraction which may not result in a record. To be sure consult a criminal defense lawyer.
The worst case scenario is a fine. Public urination is usually a county code violation. There is no misdemeanor for public urination. You should have received a court date when you received the citation. If you did not then you should go to the court clerks office where they deal with infractions and ask them.
There is a new law that went into effect January 1, 2015. I call it the "one free ride" law. Most criminal attorneys know about it and it will be most beneficial for your case. You should receive a letter in the mail soon. The statute of limitations for misdemeanors is one year. Best.
This is a general statement regarding law and facts and should not be construed as an attorney-client relationship or a solicitation for same.
worst case is a fine. If your fact pattern is sympathetic (long drive, no where to stop to use a rest room) as opposed to being drunk and peeing in someone's yard, then you may actually get it dismissed.
You don't need a lawyer, just be prepared to state your case and apologize.
