My son's father is in prison . has been for 1 year. He coerced me into human trafficking to support him financially and while in prison He made threats of retaliation to me and told me to send him money while he was incarcerated. Can I press charges against him for trafficking me and for taking money from me even though he's been in prison for a year? I was threatened by him and told to go work for him on numerous occasions and I'm wanting to press charges before he gets put of prison because I hear he may be released early and I fear for mine and our sons safety.
People don’t “press charges” they just report things to the police. It is up to the police, along with the prosecutor, to investigate and determine if there is a case to prosecute.
The general statute of limitations for Idaho felonies is 5 years. For misdemeanors, 1 year. Depending on the facts, federal law might be in play and I do not practice in that area. I would assume fed law has lengthy SOLs.
