My daughter's biological father has never been in her life. He is not listed on the birth certificate BUT he was ordered to pay child support. We haven't spoken in 8 years. Currently we live in Phoenix AZ and the biological father is in Ohio (Clermont County). What is the process being in different states for my husband who has been her father since she was 3 to adopt her? I appreciate any feedback. Thank you.
It sounds to me that, since he was ordered to pay child support, at some point his paternity must have been established and, if that is the case, his parental rights need to be terminated. The Arizona statutes provide for termination based on abandonment A.R.S. 8-533B! or termination if he signs a consent to adopt A.R>S. 855(B)(7). If paternity was not established (though I find it hard to see since he was ordered to pay child support), then termination is based on A.R.S.8-533(B)(5), being served with notice of an adoption and failure to file and serve a paternity action on the birthmother within 30 days of service.
