I caused a accident with out insurance. But i was in the process of switching insurance. That same day. But got in the accident before i actually payed for the switch. Will the insurance company still take my claim
I cannot tell you if the carrier will over the claim -- you will have to solve that issue with them.
The State of Wisconsin Department of Transportation requires all drivers to carry and show proof of financial responsibility when requested. Depending on the circumstance, you could incur a $500 penalty and lose your driving privileges if you’re caught driving without insurance in Wisconsin. Offering fraudulent proof of insurance may cost you a fine of up to $5,000.
In no way am I offering you legal advice, and in no way has my comment created an attorney-client relationship. You are not to rely upon my note above in any way, but insted need to sit down with counsel and share all relevant facts before receiving fully-informed legal advice. If you want to be completely sure of your rights, you must sit down with an experienced attorney to be fully aware of your rights. Finally, please forgive any typographical errors in my note!
No they will not take your claim. There may have been a grace time from your last policy, but not likely.
If you cancelled your old policy before the new policy was bound, neither company is likely to pay, but you can try submitting the claim to the new company. They will look at the time of the crash, and the time the new binder was entered. In addition to the fines for driving without insurance, you face DOT safety responsibility proceedings, and if you are found liable, your license and registrations will be suspended until you cover the damages. http://wisconsindot.gov/Pages/dmv/license-drvs/rcd-crsh-rpt/srlaw.aspx
