a neighbor has the dominant estate and I own the servient estate on an easement the neighbor, without my permission or approval, installed a culvert that is on my side of a property line, I am taking him to court for other issues and want to add this to the list. How much time must I give him to remove/move this encroachment on my property? what is the minimum time
I don't practice in TX, but I am not aware of any minimum time that exists in any state law to provide such notice. However, if you have a written easement, it may include a provision which requires that notice be given to the other party for a number of events described in the easement. You should check the language of the easement and discuss this with your attorney.
