Our lender filed a foreclosure only 21 days after the default letter. which did not even give a required reinstatement amount.
The only statutory penalty for a lender failing to provide you with a 30 day Notice of Intent to Foreclose is that it might not be able to collect attorneys fees from you in the judgment. Given the many thousands of dollars they are losing by foreclosing, the lender is not likely concerned about the extra couple of thousand it would lose as a result of failing to wait 30 days.
Whether your MORTGAGE requires 30 days notice, however, is a different matter and could be an affirmative defense to the foreclosure.
