I'm currently a resident in Oklahoma and my husband is incarcerated in California. We have no children or property and both of us want the divorce. What would be the easiest and fastest way to get a divorce.
Easiest way to get this done is hire an attorney to file the divorce in the county where you live. If all is agreed it can be completed quickly.
This communication does not create an attorney/client relationship and is not legal advice. ALWAYS conduct a detailed in-person consultation with an attorney before taking any legal action or making any decision that could impact in any way your legal matter.
So long as you have lived in Oklahoma for over 6 months you can file in the county where you have lived for at least 30 days. If you and your soon-to-be-ex are in complete agreement, you will still need him to sign a Waiver and if possible the Decree in order to avoid having to have him served. You would be money ahead to hire a lawyer to do this for you.
File a petition and see if he will sign a waiver or you will need to serve him at the prison.
