The difference between being convicted of a crime and going to prison or not going to prison is whether or not you go to prison. If you are convicted and do not go to prison you are placed on probation. Many factors play a part in whether you get probation, such as, severity of the crime, prior criminal history, likelihood of reoffending to name a few.
