I was told by an attorney today that in order to sue a government entity in California you must do so within 6 months to 1 year from the date it happened, however, he said that as of 2009 if the injured person was a minor then the statute is up when they turn 26 years old.
Can anyone shed light on this please?
Regardless of age the SOL against a public entity for filing a claim is 6 months within the incident.
The information is incorrect. A minor's claim is still governed by Government Code,Section 911.4 .The statute is tricky with narrow exceptions such as incompetence, lack of a guardian etc. If filing is not done within six months,you have to obtain leave of court within one year from the time the claim accrued.
