I've Got A Dui An Have Failed 3 drug tests in 9 months...What should I Do ?
You need a criminal defense attorney to assist you in this matter.
Please note that this is not legal advice, but merely, an answer to guide you in the proper direction. Additionally, no attorney-client privilege has been established. “No representation is made that the quality of the legal services to be performed is greater than the quality of legal services performed by other lawyers.”
If it is true that you have failed three drug screens over the past nine months, then it is very likely the trial court holding supervision over this case will simply give up on efforts at rehabilitation and order your immediate incarceration to serve out the remainder of your sentence. As a general statement, incarceration for probation violation is considered a "last resort" by the supervising court but it is certainly within the court's prerogative to order your probationary sentence terminated and immediate incarceration. If you were sentenced to serve a one year sentence, with the jail sentence suspended pending satisfactory completion of probation, then the court may very well find that your probation has not been "satisfactory" and order incarceration.
Your best course of action is to retain legal counsel to assist you in this matter.
I agree with the previous responses - you need to hire an attorney, you are looking at sanctions / jail time. I will add that proof of employment can be used by your attorney to try and negotiate with the Judge.
