Your first step it to get attorneys. Everyone needs a separate attorney. Because your husband is in jail, he has a court-appointed attorney. That person can file a motion to get his bond reduced. Whether or not it gets reduced will be up to a judge at a hearing. The Court may find that you cannot afford an attorney and appoint someone to represent you, but indigency is not assumed when you are out on bond. Your attorneys will do everything they can to get your cases dismissed. However, they will be assigned to a drug court prosecutor, and this will not be an easy task. If you are willing to participate in their prosecution of your aunt, this may help you.

You and your husband need a criminal defense attorney today! It is possible that once this situation has been properly explained to the prosecutor (with proof of course) that the charges will be dropped. However, until then, the prosecutor is just going to assume that you and your husband were helping his aunt run a drug ring out of her house. So, first hire a criminal defense attorney, then give him or her proof that you and your husband don't visit there often, where you two live, what you do, etc. etc. Just everything to prove to the prosecutor that you two didn't know his aunt did drugs, just came to use her bathroom and then she got busted. If you hire a good one, then the case might be dismissed. However, be warned there is a possibility that the charges never get dropped and you two end up defending yourself at trial on these charges. So best advice, hire counsel now.
