I work in facilities maintenance in NJ. Recently a co-worker told my boss that I was taking kick-backs from a subcontractor (he would perform a service for a client, charge my company X amount of dollars then give me a cut of the service call cost in exchange for giving him more business). This is 100% untrue. The woman who made these accusations is lying about other co-workers on top of what she said about me. I want her to feel some recourse for her lies before myself or others get fired. I know that what she is saying about me is untrue and ILLEGAL. Her and her slander need to be shut down before she destroys mine or any of my coworkers careers. HELP!
The first place to look would be any employment manual or employee handbook, to check the proper reporting within your employer's rules. Report this employee for making these improper allegations. You may be able to address internally.
Failing that, you would probably have to consult with a lawyer in your area to consider a possible restraining order or a libel/slander action. However, there are a number of elements to a slander action that you should be aware of. (1) there has to be a knowingly false statement made about you, either in writing (libel) or verbally (slander); (2) actually "published" to third parties; and (3) damage. Mere opinions are not slanderous. So, when you say that someone accused you of taking kick-backs, it is important to determine whether she said "I think he's taking kick-backs" (which may be an opinion) v. "he is taking kick-backs" (which would be a statement of "fact", regardless of whether it's true or not).
