Before the most recent modification in February 2012, I paid all insurance and all uncovered medical. With the recent modification, our pro rata portions of support are 42.71/57.29. The new order says "Regarding future uncovered medical expenses, each parent will have 30 days to reimburse the incurring party his or her share of said uncovered medical expenses..." It goes on to say we have 30 days to inform and 30 days to pay, but that's it. I do not know what my share is based on the new laws. My ex is still sending me the entire bill for uncovered medical. I still carry the insurance for the kids. This was an "Order by consent" drawn by her attorney, and her attorney will not tell me what the "shares" are. HELP!
You need to look at the bottom of the first page of the Child Support Worksheet. If you do not have a copy, it should have been filed with the court along with the Consent Order.
I am exclusively a family law attorney, practicing primarily in the metro Atlanta, Georgia trial courts. However, I handle appeals from anywhere in Georgia.
Each parent's share of uncovered medical expenses is determined by their child support order, not by law. Your portion of responsibility should be spelled out in your Child Support Worksheet and Child Support Addendum (if one was issued).
I hope this information helps answer your question(s).
