My husband is retaliating about me serving him papers for divorce from bed and board, and I took my daughter down to a neighbors house to play with her friend out side in her treehouse and I walked back to house to get my vehicle to park infront of daughter's friend house, my daughter was only a few seconds away and there were three other children playing over there as well with no parents. But it was on the same block and i could see her house and my daughter from our home. My husband says that was neglect, is this true? I just walked down to our house for like 10 seconds and drove back to her friends house to check on her. She never went in their home just outside with other children playing.
Neglect is defined in the juvenile code under ncgs 7B-101(15) as a child who:
1. Does not receive proper care, supervision, or discipline from the child's parent, custodian or guardian; or
2. Has been abandoned; or
3. Is not provided necessary remedial care; or
4. Lives in an environment that is injurious to the child's welfare; or
5. Has been placed for care or adoption in violation of law.
