I am 18 with no prior criminal convictions. Over the last 1.5 years I have been charged with 19 felonies (including poss heroin, poss cocaine, poss cs in a prison/jail, break and enter a motor vehicle, larceny of a firearm, and poss stolen firearm) and about 30 misdemeanors (most are larceny, poss stolen goods, simple poss of cs, and driving without a license) in 3 different counties. I am out on bond with 3 different bail bonds companies, totaling about $130,000. I have warrants right now for FTA on a misdemeanor larceny, misdemeanor larceny, and my second FTA for felony poss heroin, poss cocaine, poss cs in prison/jail, and simple poss of a sched VI cs. Drugs were a key factor in my poor decision making leading to each of these charges. I was in a drug rehab for 45 days less than a year ago. I am thinking of checking back into rehab, to avoid being arrested also I need to go. My question is, what impact, if any, would going to rehab right now have on my current legal situation? More specifically, is it still possible for me to avoid active jail time even though i have 2 FTAs on felony drug charges? Is there a way for me to get rid of the arrest warrant without being arrested?
While rehab may be both necessary and appropriate, I think the best thing to do is IMMEDIATELY RETAIN LEGAL COUNSEL.
Using treatment as a basis to avoid Service of Process is never a good idea. Indeed, nothing prevents law enforcement from coming into the facility and taking someone to jail.
You are to be commended for addressing the issue, recognizing substance abuse is something that needs to be addressed head-on.
