An 18 woman I know has had sex with a 17 year old boy. He is now talking about it to anyone that will listen. Will a mandatory reporter have to turn this in if they hear about it? Within how many years can he decide to claim it was not consensual? She has graduated he is still in high school.
In WA, a sex crime committed against a person under 18 generally can be charged until the person is 30.
"Will a mandatory reporter have to turn this in if they hear about it?" If a mandatory reporter reasonably believes a minor has been raped, the mandatory reporter must report the alleged rape.
Unless the boy was drugged or threatened, it may be difficult for most persons to believe that most 17-year-old boys can be physically overpowered by an 18-year-old woman. Would a reasonable person believe a 17-year-old boy is raped by an 18-year-old woman?
"change his mind and decide he did not consent" likely will introduce reasonable doubt against a conviction for the woman.
They each likely need to take a step back, review the specific facts with disinterested adults, and decide what happened.
