My sons father is fighting for sole physical/ and joint custody. I cannot stand the thought of him having more rights that he already has, He has standard visitation. We live two totally different lives and its confusing to my 7 year old. When he is with the father, he plays filthy explicit music about murdering, drugs, and sex. I also have video footage of it. My husband and I are Christians and we do not behave this way in our house hold, we do not use profanity and we do not listen to secular music. My son told me that his dad told him that it is okay to listen to this and that me and my husband are ruining his childhood by not allowing him this kind of freedom. Please help. What are my chances with this? We have a nice home, stable income and no record of harm, criminal or anything. My son is well kept, excelling in school and is happy at home. Will the judge hear this plead?
The Court will consider a long list of factors when making the custody/visitation determination, and I believe the information you have shared would be relevant to the proceeding. This does not mean the Court will decide in your favor, though. You should contact an attorney in your area for more advice.
