i applied for American visit visa and i been refused now i want to apply again but i forgot about my previous job dates when did i start and finish and about my school dates so would it effect my visa if i change the dates? and i already applied for permannet green card on spouse base so should i take a risk to apply visit visa too?
You will not be issued a visitor visa if you have an immigrant visa process pending.
Due to the nature of this forum, Attorney Maria J. Marty does not have all the information required to provide legal advice. Accordingly, her responses on Avvo are intended as general and not legal advice.
"i forgot about my previous job dates when did i start and finish and about my school dates". You better do your research and find out the correct dates. If your answers keep changing, the US government may decide that you are trying to lie. The consequences to you may include being barred for life from entering the US for any reason.
If you have a pending immigrant visa petition, chances are good that you are not going to be granted a tourist visa unless you are extremely wealthy, very famous. You likely will not be able to convince that consular officer that you do not have immigrant intent.
You may wish to discuss your concerns with your immigration lawyer, if you do not have one, it’s best to retain one.
It would be unwise to submit conflicting information for an immigration benefit.
most likely they will not give you a visitor's visa. The reason is the purpose of that visa is to visit and the purpose of the application based on spouse is to move to the U.S. permanently. these two purposes contradict each other, that is why they deny tourist visa in those cases. You will have to wait for your spouse's petition to go through.
