This is my second dui, and expelled from dui program twice due to the class reason, can i still reinstate?
Yes, but you won't get your license back until you complete the class. Also, the judge may find you in violation and put you in jail. Better get help from a qualified lawyer. Good luck.
The program may require you to start over from the beginning,
This answer is a general discussion of legal principles by a California lawyer. It does not create an attorney-client relationship. Free initial consultation applies only to individuals with current or potential criminal charges in Butte County, California and adjoining counties.
yOU USE THE WORD EXPELLED WHICH GENERALLY MEANS YOU CANT COME BACK. YOU WILL IN ANY EVENT NEED TO BACK TO COURT TO GET ANOTHER FORM ALLOWING YOU TO ENROLL IN THAT CLASS AGAIN, AT THAT PROVIDER, IF THEY ALLOW YOU TO, (AND MY COLLEAGUE IS CORRECT YOU MAY HAVE TO BEGIN ANEW, NO MATTER HOW FAR YOU PROGRESSED) OR ANOTHER ALCOHOL CLASS PROVIDER OFFERING THAT CLASS.
WHATEVER THE REASON FOR YOU BEING EXPELLED, I WOULD EXPECT YOU HAVE A VERY GOOD REASON WHY THAT OCCURED OR IT MAY ANGER THE JUDGE THAT YOU CANT SEEM TO GET THIS SIMPLE REQUIREMENT COMPLETED AND IT IS A POSSIBILITY THAT YOUR JUDGE COULD HOLD YOU IN VIOLATION OF YOUR PROBATION WHICH COULD RESULT IN ADDITIONAL PENALTIES, EVEN JAIL TIME.
YOU NEED TO TAKE THE COMPLETION OF THESE CLASSES SERIOUSLY. VIOLATING A COURT ORDER CAN HAVE SERIOUS NEGATIVE CONSEQUENCES WHICH ARE BEST TO BE LEARNED ABOUT FROM OTHERS, RATHER THAN FIRSTHAND.
The answer given above does not constitute specific legal advice and by reading the above response there is no attorney client relationship formed between the author and the reader. My comments are based on extremely limited information and are intended solely for informational purposes. Do not rely upon my response as specific legal advice. Every person's legal situation is fact specific and unique, and all legal problems are best handled by hiring an attorney, both competent and diligent in that field of practice. Only hire an attorney you feel comfortable with who is knowledgeable and has specific experience with your type of case. Ask questions and insist on answers. Beware of any attorney who promises you a specific result. Good Luck.
This is not uncommon. You can be reinstated, but that depends on several factors. You may need to be more immediately concerned with going to jail for a probation violation. Best to get an attorney to go to court for you, and work through your situation, to best help the judge see why you need help instead of jail.
If you were expelled twice unless there were special circumstances a judge may not be so understanding to allow you a new referral into the program without punishing you for the second violation of probation. You should seek a lawyer in area to help you with this.
