Received email from hr that I qualified for FMLA on my anniversary date . The email states job is protected for 12 weeks. Just need doctors to complete paperwork.
Doctors are requiring more time for my recovery . It seems employer is now retaliating . Now employer is stating that I due not qualify due to 50/75 mile rule.
For 2 weeks of my recovery it was my understanding I was on FMLA leave . I am physically incapacitated right now . I am Scared of losing job but they are misrepresenting all the facts to me. Received email from hr that I qualified for FMLA leave on my anniversary date in May. How did HR not know all the qualifying facts & requirements before the put it in writing that I was qualified For FMLA leave ?
Now they are trying to change their mind. Can I do anything , please help ?
There are a lot of red-flag issues here but they are all very fact specific. I would absolutely find an attorney to work with on this matter.
