My initial social security application got denied for Medicare disability after reviewing older doctors reports with no Monterey benefits . I am a county employee got hurt on the job , for lower back injury and found to be needing complex surgery by the most recent current ame (Sedentary work only )and I am not eligible for social security benefits. I only need to apply to disability Medicare to continue my county benefits . I am Under 50 . I understand lawyers take 25% of back pay or max 6000, does not apply to my case . I have 60days for reconsideration should I just fill the reconsideration package with updated medical records on my own or contact a lawyer
I would hire a lawyer if you can find one willing to handle this. It may be difficult as there is no back pay. You might talk to an experienced disability lawyer and see what they are willing to do. You may want to try your local legal aid society. If there is a nearby law school, they may have a free legal clinic. In the meantime, gather your records and submit them to social security. Your chances of being approved are greater if you have a good experienced disability lawyer.
Mr. Buskirk is correct. You should contact a local disability attorney to discuss. I am not sure how it works in California, but in Michigan if you are awarded benefits for a work related injury, workers' compensation also pays medical. You may want to contact a local workers' compensation attorney to make sure you are receiving what you are entitled to as a result of your injury.
