I have been instructed on here that mothers have all rights until we go to court and that fathers have no rights and that the father cannot keep the child from the mother and that the police must assist in getting the child back when I ask the police to assist me they told me no there was no court order and they ain't doing nothing. So why is it I'm told one thing and then told something different. Tomorrow when the courthouse opens what can I file to get my child back tomorrow
It's unfortunate that the police will not intervene in your behalf; did you explain to them that you are not married and paternity is not yet proven? If the police contact the father, what court papers or orders can he show them for keeping the child away from you? You will need to file a paternity action and my suggestion is that you also ask the judge to sign an ex parte order requiring him to immediately return the child to you. You most likely may need an attorney to help you.
