What happens when someone is incarcerated and the court grants nolle prossed?
1 attorney answer
When a case is nolle pros'd, it means the charges are dropped but can, in most cases, be brought again if the state finds it appropriate. So, if you're set on not having him near your son, and all of the father;s charges have been dropped, you'll have to make a decision about filing for custody. You should consider consulting with an experienced family law attorney about your option.
