I had an advisory claim filed against me in bankruptcy court. We filed a motion on the first complaint but then the plaintiff filed an amended complaint. The response was due last week and I can see online that nothing was filed by my attoney. I have emailed and called with no response from him. Does this mean I will lose the case? How do I get the issue corrected if my attoney doesn’t respond?
I trust you mean adversary proceeding. Your attorney may have requested an extension of time to respond, or may yet ask for an extension. if he or she does not, the court will likely not punish you for your attorney's lack of diligence.But you need to make sure an answer of appropriate motion is filed.
