I came to USA legally on H1B visa. I married a US Citizen on Aug 2018 . We filed my spousal green card applications (I-130, I-485, I-765, I-131, I-864) on Aug 2019. My green card case is in still progress with NBC, I have n't get my EAD yet from USCIS. My H1B is coming to expire on DEC 2019. My wife's (sponsor) (80K) and my income (85K) also included in I-864 (affidavit of support) document.
1. After next month (Dec 2019 - H1B expired, NO EAD yet) , my green card interview is scheduled on March 2020. Will there be any impact on my green card interview because my income has included in I-864 application and also i am not working from last 2-3 months?.
You are not required to continue to maintain H1B status after I-485 is filed assuming that you are not employed without authorization (prior to issuance of EAD) after H1B employment is terminated.
Your spouse is earning well above the "poverty" guidelines and her sole income is enough to support you. It is OK if you are not employed at time of adjustment of status interview.
