Canadian citizen, green card parents, child US and Canadian citizen, 3.5 years old. Living in California since Jan 2012. In case of divorce if mother wants to go back to Canada and father stay in California, what happens to custody?
the jurisdiction lies with the court where the child lived for at least six month. People go to court and decide issues of custody and movement of the child All of these are issues of the local state law, not US immigration law.
