During a custody case we filed contempts against each other. We signed an agreement to settle the contempts but then he voluntarily dismissed the case. What happens to the agreement? Does he still have to follow it? Or is it dismissed too?
When you say "signed an agreement", are you talking a stipulation? Was it filed with the Court with a proposed order adopting the stipulation? Was the agreement only concerning the contempts? Did you ever file an answer? Generally, if an answer has been filed, both parties are required to dismiss the action.
If the Court approved it, you're both obliged to follow it. If it was just signed, and not filed, it's in limbo. if you had an attorney, I'd follow up with her or him and find out what happened.
